These Terms & Conditions govern your use of our website and the purchase of artwork from us. By accessing this website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use this website.

Throughout these Terms & Conditions, "Gray Gardner Art", "we", "our" and "us" refer to the business trading as Gray Gardner Art.

About Us

Gray Gardner Art is an independent UK art business specialising in original paintings, limited edition fine art prints and commissioned artwork.

Placing an Order

When you place an order through our website, you are making an offer to purchase artwork subject to these Terms & Conditions.

All orders are subject to acceptance and availability.

You will receive an email confirming that your order has been received. This does not constitute acceptance of your order. A contract is formed once we confirm that your artwork has been dispatched.

Original Paintings

Every original painting is a unique work of art.

Occasionally, artwork may be exhibited or offered for sale elsewhere. In the unlikely event that an original painting has already been sold, we will contact you as soon as possible and issue a full refund.

Limited Edition Fine Art Prints

Our limited edition fine art prints are produced to order and are digitally signed and individually numbered as part of a strictly limited edition.

Minor variations in appearance may occur between different print runs due to the nature of the printing process. These variations do not affect the quality or authenticity of the artwork.

Commissions

Commissioned artwork is created specifically for each client.

The scope of the commission, estimated completion times and payment arrangements will be agreed before work begins.

Once work has commenced, commission payments are non-refundable except where required by law.

Prices

All prices are shown in Pounds Sterling (£) unless otherwise stated.

Prices may be changed without notice, although changes will not affect orders that have already been accepted.

International customers may be responsible for local taxes, customs duties or import charges.

Payment

Payment must be made in full before artwork is dispatched unless otherwise agreed in writing.

Payments are processed securely through Shopify's approved payment providers. Gray Gardner Art does not store your payment card details.

Delivery

Delivery information is available in our Shipping Policy.

Estimated delivery times are provided as guidance only and cannot be guaranteed.

Gray Gardner Art is not responsible for delays caused by postal services, couriers, customs authorities or events outside our reasonable control.

Returns & Cancellations

Your rights regarding cancellations, returns and refunds are explained in our Returns, Cancellations & Damaged Artwork Policy.

Nothing within these Terms & Conditions affects your statutory rights under UK consumer law.

Product Images & Colour Accuracy

We make every effort to display our artwork as accurately as possible.

However, colours may appear differently depending on your monitor, device or screen settings. Small variations between on-screen images and the physical artwork are normal and do not constitute a fault.

Copyright & Intellectual Property

All artwork, images, photographs, logos, designs and written content displayed on this website remain the intellectual property of Gray Gardner unless otherwise stated.

Purchasing artwork does not transfer copyright.

Artwork may not be copied, reproduced, scanned, published, distributed, adapted or used commercially without prior written permission.

The purchase of an original painting or limited edition print grants ownership of the physical artwork only.

We aim to ensure that all information on this website is accurate and up to date.

Occasionally, errors relating to descriptions, pricing or availability may occur. We reserve the right to correct such errors and, where necessary, cancel an order before dispatch, providing a full refund if payment has already been made.

Limitation of Liability

Nothing within these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded.

Subject to the above, Gray Gardner Art shall not be liable for indirect or consequential losses arising from the use of this website or the purchase of artwork.
